Attorney General Jeff Landry Praises Court Decision Blocking ACA Overreach

Louisiana Attorney General Jeff Landry has once again joined other Attorneys General from across the country to successfully block the Obama Administration's attempts to exceed its legal authority and circumvent Congress.

A federal court has granted a nationwide preliminary injunction blocking the President's new federal health rules from forcing doctors to act contrary to their medical judgment or religious beliefs.

The law, scheduled to take effect New Years Day, would have forced the Office of Group Benefits (OGB) and a large number of private employers and insurers to amend insurance coverage to provide for gender reassignment and abortion, at a time where OGB is cutting coverage for cancer treatments.

After the court ruling, General Landry issued the following statement:

“I applaud District Judge O’Conner's ruling to protect physicians nationwide. If enacted, the new rule would have forced taxpayers and healthcare workers to provide services contrary to patients' best interests and in violation of providers' deeply held religious beliefs. I will continue to work with my fellow attorneys general to assure that citizen's constitutional rights are protected against federal overreach."


In July, the U.S. Department of Health and Human Services implemented a new rule “interpreting” the definition of “sex” within the Affordable Care Act as a state of mind, not a biological fact. When Congress enacted the law, it used the term “sex” as a biological category. The Obama Administration has repeatedly attempted to redefine the law so that the term “sex” means one’s “internal sense of gender which may be male, female, neither, or a combination of male and female,” even though the president lacks the authority to rewrite the law. In April - Governor John Bel Edwards attempted to do the same thing with an executive order, which has since also been blocked by a state court.
